  •  Out of work due to an accident?
  •  Dealing with damage done to your vehicle or personal property that was caused by someone else?

Car Accidents

Many car accidents lead to injury, and in some cases, even fatalities. When car accidents aren't serious, parties involved typically exchange information, file a police report, and move on. However, if the accident results in damage to property, injuries, or death, the situation is much more complicated.

In such cases, victims are entitled to compensation for their losses, compensatory damages, and possibly even punitive damages.

In most cases, one or more people involved in a car accident can be held legally responsible. The responsible party may be a driver in the crash, the vehicle manufacturer, and/or someone responsible for maintaining the roadway. Legal responsibility for the crash depends on the specific circumstances surrounding the accident. Sometimes more than one party may share responsibility. If this occurs, the degree each party's responsibility for causing the wreck will determine who receives compensation and how much compensation they receive.

Common car accident injuries include:

Motorcycle Accident

The National Highway Traffic Safety Administration (NHTSA) says motorcyclists are eight times more likely to be injured and 32 times more likely to die in a crash than other motor vehicle accident victims.

Most cyclists are safe drivers, but sometimes automobile drivers are careless around motorcycles and scooters. Motorcycle accident victims have high medical bills and sometimes limited insurance coverage. Sometimes insurance companies will contact a victim through an adjuster who attempts to limit the amount of money a victim may be entitled to.

Motorcycle riders enjoy freedoms that come with riding two-wheelers, but they are also left exposed to dangers that automobile and truck drivers are not. The lack of any protective barriers between motorcycle and road, as well as the difficulty that other motorists may have in seeing and anticipating a motorcycle, expose riders to a significant amount of personal injury.

In most motorcycle accidents involving other vehicles, the driver of the other vehicle is at fault.

Distracted Drivers

Distracted driving is one of the most common causes of car accidents. When drivers are not paying attention to the road, the other vehicles around them, or pedestrians, it dramatically increases the risk of accidents and even deaths. Drivers can become distracted for a number of different reasons; of course, the most common types of distractions involve the cell phone – whether it be texting, talking on the phone, sending emails, or any other distracting actions.

Other common causes of distracted driving accidents include adjusting the radio volume, looking for something in a purse, having conversations with other drivers, or simply thinking about something else.

If you are injured because of another driver's distracted driving, you may be entitled to compensation. Personal injury damages from texting while driving injuries or injuries related to another type of distracted driving may include compensation for medical expenses, mental anguish, pain and suffering, loss of physical capacity, loss of wage-earning capacity, and loss of enjoyment of life.

In some distracted driving cases, the court may also award punitive damages, which are additional damages designed to punish the party at fault for his or her extreme negligence. In order to obtain these damages, you must first prove that the driver was at fault. Depending on the circumstances, this may involve collecting evidence and/or soliciting testimony from witnesses.

DWI

Someone dies in an alcohol-related traffic crash every 30 minutes. A car wreck caused by a drunk driver can result in serious personal injury and even wrongful death. Today, there is a growing concern about persons driving under the influence and the personal injury suffered by innocent citizens.

Personal injury damages from drunk drivers may include medical expenses, loss of wage earning capacity, pain and suffering and mental anguish, loss of physical capacity, and loss of enjoyment of life.

Workplace Injury

We're the most industrious nation in the world, and that means more on-the-job injuries as well. In 2000, there were almost 4 million disabling workplace injuries and 5,200 unintentional workplace deaths in the United States.

According to Injury Facts, 11 unintentional deaths and 2,340 disabling injuries occur every hour in American workplaces. As many American workers have experienced, the back is the body part most frequently injured on the job.

Work-related Injuries can include

We all know worker's compensation benefits will pay for medical bills and limited lost wages, but what about damages for pain and suffering?

Wrongful Death

When the negligence of others causes the death of a loved one, it also causes grief, suffering, medical expenses, loss of income, and a shattered life for those left behind.

A wrongful death claim alleges that the deceased person was killed because of the defendant's negligence, and the surviving dependents or beneficiaries are entitled to monetary compensation because of the defendant's conduct.

Family members couldn't make this type of claim in the past because the claim died with the victim, or so it was believed. But today, individual states have wrongful death statutes to give the survivors recourse for their loss.

The kinds of damages that may be recoverable in a wrongful death claim are:

Premises Liability

Unfortunately, injuries can occur at any time or any place. Property owners, as well as businesses, have the responsibility to provide a safe environment for you and your family. The owner is legally accountable when they fail to do so and an injury occurs. This is premises liability.

While trying to cope with physical pain and recovery, victims are often faced with enormous medical bills from their injuries, time missed from work, and emotional scars. If you or someone you love has been seriously injured through the fault of negligence, you may have the right to recover damages.
